Proposed Denial Of Eureka Resources Oil & Gas Wastewater Treatment Permit
The Department of Environmental Protection published notice in the October 11 PA Bulletin announcing it proposes to deny the renewal of a NPDES wastewater permit for Eureka Resources LLC oil and gas wastewater treatment facility in Standing Stone Township in Bradford County. (PA Bulletin, page 7206) Read more here.
Megan Lehman, a spokesperson for DEP’s Northcentral Regional Office, said, “On September 29, 2025, DEP sent correspondence to Eureka Resources notifying them of its intent to terminate/deny both the administratively extended NPDES Permit and their renewal application for this site after publication in the PA Bulletin and upon review of any comments received.
“The reason for the termination is the continued nonpayment of annual fees despite multiple pre-denial letters, notices of violation, and emailed correspondence.”

Calvin & Julia McCutcheon [1,149 Days]
October 2, 2025 follow-up inspection of the Frank Marion & Vashti Cowan Davie 2 conventional well in Allegheny Township, Westmoreland County found it was still abandoned and not plugged and failed to submit production, waste generation and well integrity reports since 2009. Original violations issued August 10, 2022. Violations continued. Response requested by October 23. DEP inspection report. McCutcheon holds 1 permit.
MTN V Oil & Gas Inc. [886 Days]
October 7, 2025 follow-up inspection of the John J. DeFloria 2 conventional well in Loyalhanna Township, Westmoreland County found the well still abandoned and not plugged. The well has not produced since 2015. The original violations were issued on May 5, 2023-- 886 days ago. Violations continued. Response requested by October 27. DEP inspection report. MTN V holds 1,011 permits.
H & S Gas & Oil [811 Days]
October 7, 2025 follow-up inspection of the Radakovich 1 conventional well in Penn Township, Westmoreland County found the well is still abandoned and not plugged and well head appears to be open. The owner also failed to submit production, waste generation and well integrity reports for last 15 years. Owner failed to correct or respond to violations originally issued July 19, 2023-- 811 days ago. Violations continued. Response requested by October 27. DEP inspection report. H & S Gas holds 4 permits.
Apollo Resources LLC [626 Days]
September 29, 2025 inspections of 5 conventional wells in Clearfield Township, Cambria County found the wells still abandoned and not plugged. Original violations issued January 12, 2024. Response requested by October 19. The wells include County of Cambria (Ivory) 1, County of Cambria (Sharretts) 2, County of Cambria (Yahner) 6, County of Cambria (McConnell) 5 and County of Cambria (Brzez/Hum) 3. Apollo holds 1,896 permits.
Pin Oak Energy Partners LLC
October 6 & 7, 2025 inspections of 4 conventional wells in Conneaut Township, Crawford County found the wells abandoned and not plugged. The owner also failed to submit annual production, waste generation and well integrity reports. The wells include Daniel M. Overmoyer 1, Daniel M. Overmoyer 2, Daniel M. Overmoyer 6, and C. Greenawalt 1. Response requested by Nov. 3. DEP inspection reports. Pin Oak holds 909 permits.

October 7, 2025 routine inspection of the Lampman 4 conventional well in Conneaut Township, Crawford found the well abandoned and not plugged. The owner failed to submit production, waste generation and well integrity reports. No record of the well ever being inspected. Violations issued. Response requested by November 3. DEP inspection report. Lampman holds 1 permit.
Stone Ridge Energy LLC
September 29, 2025 inspection of the Minor 1 conventional well in Springhill Township, Fayette County in response to a complaint found the well abandoned and not plugged. Response requested by October 29. DEP inspection report. Stone Ridge holds 196 permits.

Seneca Resources Co LLC [344 Days]
October 2, 2025 follow-up inspection of the Taft 851 shale gas well pad in Middlebury Township, Tioga County found evidence of continuing wastewater spills on the pad and confirmed with water samples collected on August 21, 2025. Violations for contaminated water on the well pad, failure to notify DEP of spills and related infractions were originally issued on October 23, 2024 and documented again during a July 11, 2025 inspection. DEP recommends the owner monitor the conditions on the pad surface and the sediment basin and remove elevated conductance fluids and soils as discovered. DEP inspection report.
Chesapeake Appalachia LLC [125 Days]
October 8, 2025 follow-up inspection of the Kerrick shale gas well pad in Asylum Township, Bradford County found evidence of continuing releases of production wastewater pooling on several areas of the pad and outside secondary containment. These were characterized as “recurring violations” by DEP since the original spills were discovered on June 5, 2025. The owner also failed to notify DEP of the releases. Original violations continued. Response requested by October 30. Issue referred to DEP Environmental Cleanup Program. DEP inspection report.
Seneca Resources Co LLC
October 8, 2025 inspection of the Crooked Creek To Goodwin Water Pipeline construction project in Charleston Township, Tioga County in response to a report of an October 7 “inadvertent return” of bentonite drilling mud during horizontal drilling operations under Crooked Creek. The pipeline connects the Crooked Creek surface water withdrawal station to the Goodwin shale gas well pad. An estimated 20 gallons of drilling fluid spilled and was recovered within the permit areas and without impacting a waterway. Drilling resumed without No violations issued. DEP inspection report.

Apollo Resources LLC [472 Days]
October 3, 2025 follow-up inspection of the WAFRA Inc 1 conventional well in Mount Pleasant Township, Westmoreland County found a spill discovered during a June 18, 2024 inspection was remediated, although the owner did not respond to the violation. The owner failed to completely restore the well site by removing equipment after drilling was completed. June 18, 2024 violations continued. No response requested from owner. DEP inspection report. Apollo Resources holds 1,896 permits.
Michael D. Graham [398 Days]
October 2, 2025 follow-up inspection of the Farrah 1 conventional well in Smith Township, Washington County found the owner still failed to complete the cleanup of multiple spills and releases from storage tanks at the site originally discovered on August 30, 2024. No response from the owner to the violations. Owner again requested to remediate the release, no specific deadline for a response. DEP inspection report. Graham holds 30 permits.
First Amer Energy Inc. [339 Days]
October 2, 2025 inspection of the Warrant 4917 4917 156 conventional well in Foster Township, Warren County found the owner failed to comply with an October 28, 2024 DEP Order requiring the cleanup of a release at the site. June 4, 2025 violations for failing to comply with the Order continued. No response requested. DEP inspection report. First Amer Energy holds 586 permits.
Thomas & Jean Thurma [198 Days]
October 7, 2025 follow-up inspection of the Barnhart 4 conventional well in Independence Township, Beaver County found no evidence of any cleanup activity related to the crude oil spill discovered by DEP at this site on April 3, 2025. The owner also failed to respond to the violations in April. Response requested by October 14. DEP inspection report. Thurma’s hold 7 permits.
Apollo Resources LLC [141 Days]
October 3, 2025 follow-up inspection of the Nelson 2 conventional well in Dunbar Township, Fayette County found fluid actively leaking from the wellhead. Original violation issued May 15, 2025, but there was no response from the owner. Violation continued. Response requested, but no deadline set. DEP inspection report.
Windfall Energy Inc. N V
October 2, 2025 inspection of the Municipal Authority 1 conventional well in Oklahoma Borough, Westmoreland County in response to a complaint found severely corroded pipes and leaks from the wastewater tank. An attempt to contact the well owner failed because the voicemail box was full. DEP said this well is already under an Enforcement Order to deal with violations. New violations issued. Response requested by October 14. DEP inspection report.

October 9, 2025 routine inspection of the South Unit shale gas well SGL-12L 2HX in Leroy Township, Bradford County found the well venting gas to the atmosphere from the annulus at 100% of explosive limit. Violations issued for casing/cementing failure and failure to notify DEP of the issue. Violations issued. Well drilling in April 2022. Response requested by November 10. DEP inspection report.
EXCO Resources PA LLC
September 29, 2025 inspection of the Wistar Shafter Tracts 1H shale gas well in Shrewsbury Township, Sullivan County as part of a regular monitoring program for well casing/cementing failure at this site. Gas was detected in the annulus. Original violation issued on March 13, 2012. Violation continued. Monitoring will continue. DEP inspection report.

October 9, 2025 inspection of the Roy Thomson 1 conventional well in North East Township, Erie County found the well was venting gas due to defective casing/cementing and a storage tank was severely corroded and no longer in use. The owner also failed to submit a well integrity report. Response requested by November 7. DEP inspection report.
Failure To Comply With Pipeline/Well Pad E&S Requirements
Pennhills Resources LLC
October 7, 2025 inspection of the 1.26 mile Owls Nest shale gas well pad Z pipeline construction right-of-way in Jenks Township, Forest County and Highland Township, Elk County found the owner failed to comply with multiple erosion and sedimentation control requirements and disturbs an area in excess of what the GP-5 authorizes. Written violation issued on October 14 [includes inspection report] for failure to comply with permit and a second notice withdrawing eligibility for four GP-5 erosion and sedimentation control permits. The owner must apply for a Chapter 105 permit for the project.

October 6, 2025 routine inspection of the [massive] Downer shale gas well pad construction site in Perry Township, Greene County found multiple erosion and sedimentation violations, multiple slope failures, failed to stabilize areas during work cessations and overtopping E & S controls. Violations issued. Response requested by October 24. DEP inspection report.

September 26, 2025 routine inspection of the [huge] More Cowbell shale gas well pad construction site in Perry Township, Greene County found multiple erosion and sedimentation violations, failure to stabilize areas, slope failures and overtopping E & S controls. Response requested by October 15. DEP inspection report.
Equitrans Water SVC (PA) LLC [Army Cut Worm Infestation]
October 6, 2025 administrative inspection of the PADAYW118 Waterline in Jackson Township, Greene County in response to a notification by the owner of an Army Cut Worm infestation that is destroying erosion and sediment control vegetation. Penn State Extension guidance says once the pests are observed it is too late for control measures. EQT will document conditions to ensure compliance with E & S measures. DEP inspection report.
Failure To Comply With Encroachment Permits
Catalyst Energy Inc.
October 7, 2025 routine inspection of the replacement of a drainage culvert pipe on an access road in Hickory Township, Forest County found the company failed to comply with General Permit-7 requiring at least 12-inch cover over the pipe and a lack of riprap and approved bedding material. DEP also found water running under the culvert pipe. Violations issued. Response requested by October 24. DEP inspection report.
Pin Oak Energy Partners LLC [393 Days]
October 14, 2025 routine inspection of the Armstrong Forest 1097 conventional well in Ridgway Township, Elk County found the owner failed to obtain a permit for a gas gathering pipeline crossing of Pine Run (High Quality) after a previous pipeline was found to be washed away in September 16, 2024. The plastic gathering line was looped through a tree to cross the stream. The owner also failed to remove the previous pipeline. Violations issued. Response due October 29. DEP inspection report.
Failed To Restore Shale Gas Impoundment/Well Pad
STL Resources LLC [2,463 Days]
October 7, 2025 inspection of the Endless MTN Energy SGL 268 shale gas well in Morris Township, Tioga County and found the freshwater impoundment and well pad were not restored as required 9 months after the expiration of the last well permit. Original violation issued January 9, 2019. Violation continued. No response requested of owner. DEP inspection report.
Failure To Restore Conventional Well Sites
First American Energy Inc. [262 Days]
October 3, 2025 inspections of 3 conventional wells in Mead Township, Warren County found the owner failed to restore the well sites as required by law since January 14, 2025. The wells include-- PAPCO 1435, PAPCO 1438 and PAPCO 1441. Response requested by October 22.
