DEP Issues 2 Chapter 105 Permits For Project Hazelnut A.I. Data Centers Offsite Utilities In West Hazleton Borough, Luzerne County

The Department of Environmental Protection published notices in the July 4 PA Bulletin announcing it has issued two Chapter 105 permits to the Municipal Authority of Hazle Township Authority 
and the Greater Hazleton Joint Sewer Authority for the Project Hazelnut A.I. Data Center Project offsite utilities projects in West Hazleton Borough, Luzerne County.  (PA Bulletin, pages 3915 + 3916)

The projects are located approximately 0.46 mile southwest of the intersection of Jaycee Drive and Unico Drive.

The E4002226-007 permit was issued to the Greater Hazleton Joint Sewer Authority and includes coverage for--

1) A fill in the floodway of Black Creek (CWF, MF) consisting of a 1,320 ft2 industrial wastewater pump station building, concrete effluent diversion channel, portions of a 10-foot wide asphalt access road, and a 4-foot wide concrete sidewalk. This impact will result in a net fill of 71 yd3 within the floodway. 

2) To modify an existing wastewater effluent outfall in the floodway of Black Creek (CWF, MF) consisting of the replacement of a 15-LF portion of a 36-inch diameter of ductile iron pipe. 

3) A utility crossing 20-LF of the floodway of Black Creek (CWF, MF) consisting of a 2-inch diameter PVC sump pump conveyance pipe. 

4) A utility crossing 25-LF of the floodway of Black Creek (CWF, MF) consisting of a 2-inch diameter PVC water supply pipe. 

5) A utility crossing of Black Creek (CWF, MF) consisting of a 16-inch diameter ductile iron wastewater effluent force main encased with an 80-foot long, 36-inch diameter steel pipe and installed via directional drilling. 

6) A utility crossing of Black Creek (CWF, MF) consisting of a 10-inch diameter ductile iron wastewater effluent force main encased with an 80-foot long, 24-inch diameter steel pipe and installed via directional drilling.

7) To remove an existing aerial utility crossing of Black Creek (CWF, MF) consisting of a 16-inch diameter ductile iron wastewater effluent force main and steel pipe bridge superstructure and replace with a 24-inch diameter ductile iron wastewater effluent force main and a steel pipe bridge superstructure having two (2) 80.5-foot spans.

8) To remove an existing 8-foot tall chain link fence within the floodway of Black Creek (CWF, MF) and to replace in-kind. 

The E4002226-008 permit was issued to the Municipal Authority of Hazle Township and includes coverage for--

1) A utility crossing of 0.03 acre of PEM Wetlands (Other) consisting of an 18-inch diameter PVC wastewater effluent force main.

2) A utility crossing of 0.05 acre of PEM Wetlands (Other) consisting of an 18-inch diameter PVC wastewater effluent force main. 

3) A utility crossing of 0.07 acre of PEM Wetlands (EV) consisting of an 18-inch diameter PVC wastewater effluent force main. 

4) A utility crossing of Stony Creek (CWF, MF) consisting of a 16-inch diameter ductile iron wastewater effluent pipe encased by a 36-inch diameter steel pipe and installed via directional drilling.

5) A utility crossing of Stony Creek (CWF, MF) consisting of a 10-inch diameter ductile iron wastewater effluent pipe encased by a 24-inch diameter steel pipe and installed via directional drilling.

Anyone aggrieved by this decision as 30 days from this notice to file an appeal with the Environmental Hearing Board.
