Three Rivers Waterkeeper Announces Intent To Sue Neville Chemical Company For Polluting Ohio River Near Pittsburgh

On April 21, the
Three Rivers Waterkeeper announced they sent a formal notice of intent to sue Neville Chemical Company to stop intermittent discharges from its Neville Island Plant into the Ohio River.

The company has consistently self-reported discharge violations of harmful hydrocarbons, such as benzene, as well as pH, total suspended solids, and oil and grease. 

Three Rivers Waterkeeper is represented by Appalachian Mountain Advocates and have utilized the facility's own self-reporting data to document consistent violations of their water discharge permit and federal Clean Water Act.

The self-reporting data submitted to the Department by Neville Chemical from July 2021 to the present show that the company has repeatedly violated and continues to violate numerous discharge limitations, sampling standards, and monitoring and reporting requirements.

Based on the company's self-reported data, Three Rivers Waterkeeper and Appalachian Mountain Advocates counted that Neville Chemical is liable for as many as 9,494 days of violations since July 2021.

“There needs to be real penalties and compliance schedules to these facilities that consistently exceed their permits and threaten our drinking water sources. Without action from our Department of Environmental Protection, we are essentially giving these facilities the ability to pollute our waters without consequence” said Dr. Heather Hulton VanTassel, Executive Director, Three Rivers Waterkeeper. 

“The Federal Clean Water Act is clear, and ignoring these violations only harms our waters and communities” says Hulton VanTassel, Executive Director.  “When polluters dump chemicals into our source drinking water for free, it is up to us, the rate payer, to either pay to clean the water before it reaches our tap or with our health.”
