Mountain Watershed Association Files EHB Appeal Of DEP's Approval Of The 1,452 Acre Expansion of the Rustic Ridge #1 Coal Mine In Fayette, Westmoreland Counties

On June 30, the
Mountain Watershed Association announced it filed an appeal challenging DEP’s approval of a 1,425-acre expansion of the LCT Energy, LP Rustic Ridge #1 coal mine in Donegal Township, Westmoreland County and Saltlick Township, Fayette County. 

MWA's appeal raises significant concerns regarding potential impacts on groundwater supplies, acid mine drainage pollution, and possible damage to local streams and wildlife.

The appeal was filed with the Environmental Hearing Board-- EHB Docket # 2025076.

The Laurel Highlands attracts millions of visitors annually for its natural beauty and outdoor recreational opportunities. The region generates significant economic benefits from ecosystem services, such as clean water and recreational activities, which could be impacted by environmental changes.

“Our community deserves thorough protection and transparency from DEP,” stated MWA attorney Sarah Thomas. “We have serious concerns that the approved mine expansion could negatively impact the area’s homes, water, and environment. We intend to ensure these concerns are adequately addressed.”

Residents near the existing Rustic Ridge mine have reported issues such as: reduced well water availability, property damage potentially related to subsidence, and concerns about water quality. 

A hydrogeological report commissioned by MWA suggests there is a high likelihood of reduced stream flow and increased risk of acid mine drainage in the expansion area.

Critical concerns raised in the appeal include:

-- Potential Water Depletion & Flow Alterations: Concerns exist that mining activities could change underground water movement, potentially affecting groundwater flow to local streams and water supplies.

-- Concerns Regarding Pollution Control Measures: MWA raises questions about the sufficiency of storage pond capacity and plans for sludge removal to effectively manage potential water pollution.

-- Risks of Acid Mine Drainage (AMD): Historical evidence indicates the coal seam could generate acid mine drainage, which has significant environmental implications that DEP may not have fully considered.

-- Constitutional Considerations: DEP’s approval may raise concerns related to Article I, Section 27 of the Pennsylvania Constitution, which guarantees the right to clean air and pure water.

"We are appalled that DEP would approve the expansion of LCT's Rustic Ridge coal mine when there are so many unresolved community concerns from the current active mine,” said Barbara McMillan, a resident of Donegal Township. “We believe more protection and accountability are necessary.”

Jim Miller, a Donegal Township resident, added, “After seeing the damage caused by Rustic Ridge #1, we're disappointed DEP approved an expansion into an area heavily dependent on groundwater. This appeal is essential, we cannot let history repeat itself with the Rustic Ridge expansion.”

MWA is represented in the appeal by the Law Firm of Sarah Winner and is committed to safeguarding the community’s water resources, public safety, and ecological health by holding DEP accountable to established regulations.

Unsuitable For Mining Petition

In a related action, on March 22, 2024, Mountain Watershed Association filed an appeal of another DEP decision to reject an unsuitable for surface coal mining petition covering the Rustic Ridge #1 mine expansion. [EHB Docket # 2024077]  The appeal is still pending

On January 22, 2024, the Mountain Watershed Association submitted a petition to declare almost 11,000 acres unsuitable for surface coal mining in Donegal Township, Westmoreland County.  Read more here.

On February 23, 2024, DEP rejected the petition saying, “The Department has found that the MWA’s petition lacks sufficient allegations of facts and supporting evidence to establish that the petition area is unsuitable for all or certain types of surface mining operations.”

PUC Seeks $395,000 Penalty Against UGI Utilities For 2022 Natural Gas House Explosion In Suburban Harrisburg; $50,000 Penalty Against Contractor

On June 30, the
Public Utility Commission’s independent Bureau of Investigation and Enforcement filed multiple formal complaints against UGI Utilities Inc. and Pronto Plumbing Heating Air Drains of Camp Hill, Cumberland County, stemming from a 2022 natural gas house explosion and fire in suburban Harrisburg.

The formal complaint filings follow an investigation by the PUC’s Safety Division into a house explosion and fire on Dec. 13, 2022, at 3204 Crest Road (Crest Road), Harrisburg.  

On that day, Pronto Plumbing, during excavation activities, struck and damaged a natural gas service line operated by UGI, resulting in a line rupture and a release of gas that migrated into the Crest Road residence. 

The natural gas subsequently ignited, resulting in an explosion that destroyed the residence, damaged several adjacent homes and injured two people.

During its investigation the PUC’s Safety Division explored the circumstances surrounding this incident, compliance with state and federal pipeline safety regulations, as well as compliance with Pennsylvania’s “One Call Law,” which is intended to help prevent damage to underground utility lines.

I&E’s Formal Complaints

In total, I&E has filed three formal complaints – two formal complaints against UGI and one formal complaint against Pronto Plumbing.  

The complaints center on UGI’s failure to comply with federal and state gas safety regulations as well as failure by both UGI and Pronto Plumbing to adhere to Pennsylvania’s One Call Law (PA One Call).

Complaints Against UGI Utilities

I&E’s first formal complaint against UGI alleges gas safety violations of the Public Utility Code, Commission regulations, and federal pipeline safety regulations. 

The alleged violations include, but are not limited to, failure to have written procedures, failure to follow damage prevention procedures, insufficient emergency procedures, and failure to protect the public and employees.

In its complaint, I&E seeks a civil penalty in the amount of $375,000 and numerous remedial measures by the company.

I&E’s second formal complaint against UGI alleges a violation of PA One Call, in that the company failed to mark its facilities in response to an emergency One Call locate request.  

In this second formal complaint, I&E seeks an additional administrative penalty from UGI in the amount of $20,000.

Pronto Plumbing One Call Complaint

I&E’s formal complaint against Pronto Plumbing also alleges violations of PA One Call. 

The alleged violations include failure to use prudent excavation techniques, failure to use due care in excavating an area that had not been marked, failure to immediately notify the facility owner of excavation damage, and failure to renotify the PA One Call System upon finding an unmarked excavation area.

In this complaint, I&E seeks an administrative penalty in the amount of $50,000, the statutory maximum.

Help Wanted: Ursinus College Conservation Stewardship Coordinator

Ursinus College in Montgomery County is seeking qualified candidates for a full-time Conservation Stewardship Coordinator position to work with the Office of Sustainability (OS) and the Department of Environment and Sustainability (ENVS). 

The Conservation Stewardship Coordinator will be an individual with a Master’s degree who is trained in agroecology, food forestry, community gardening, sustainable agriculture, or related field and who will primarily work to manage the year-round operations at the Campus Farm and Food Forest at the Whittaker Environmental Research Station along with other campus land management initiatives. 

The Conservation Stewardship Coordinator will collaborate with ENVS and OS on the long-term vision of the Campus Farm and Food Forest, support curricular and co-curricular activities in which the Campus Farm and Food Forest and other campus locations serve as a laboratory for collaborative student-faculty education and research, and embody a welcoming ethos that centers community and inclusion to students, faculty, staff, and external community members/partners.
