On August 28, DEP found Diversified failed to implement adequate erosion and sedimentation controls prior to beginning earth disturbance activities on the access road and loose soil had been pushed next to a tributary of Downers Run.
A small washout was observed in a portion of the road and there was evidence of heavy farm animal traffic observed on the flood gas well site.
Multiple violations were issued.
On August 30, DEP observed some repairs had been made and well plugging equipment was being staged, but repairs to the access road were not completed and a compost filter sock downslope of the well needs to be reset.
Additional violations issued for failing to construct a rock entrance to the site and for not having an updated Erosion and Sedimentation Plan onsite.
DEP requested a response by September 17.
