DEP Extends Deadline Of First Methane Pollution Report From Oil & Gas Facilities To June 1, 2024

The Department of Environmental Protection published
notice in the January 27 PA Bulletin it is extending the deadline for conventional and unconventional natural gas facility operators to submit their first methane pollution emissions report to June 1, 2024.

The notice said DEP “suspended enforcement” of the report deadline initially due on December 2, 2023 under 25 Pa. Code §§ 129.130(k)(1) and 129.140(k)(1).

In December 2022, final DEP regulations became effective on reducing volatile organic compound and methane emissions covering conventional and unconventional natural gas facilities.  Read more here.

The initial annual report submission for owners and operators of conventional oil and natural gas sources was due on December 2, 2023, addressing the time period of December 2, 2022, through December 31, 2022. 

The initial annual report submission for owners and operators of unconventional oil and natural gas sources was due on December 10, 2023, addressing the time period of December 10, 2022, through December 31, 2022. 

DEP said the initial reports are now due on June 1, 2024 and will cover the full 2023 calendar year.

“The Department's exercise of enforcement discretion does not protect an owner or operator of subject equipment from the possibility of legal challenge by third persons.”
