DEP increased the daily maximum tonnage from 300 to 500 tons/day, but the permitted monthly average of 300 tons/day did not change.
DEP also said in the notice-- “To the extent that the Schuylkill County Board of Commissioners identified specific cause to deny Liberty Soils, LLC’s application, the Department is hereby providing notice that the justification for the decision to override that recommendation is contained in the Department’s Comment Response Document.”
A copy of the Comment Response document was provided to the County with the approved modification and will also be made available on the DEP Northeast Regional Office Liberty Soils webpage.
Requests to review the permit and questions should be directed to Roger Bellas, Environmental Program Manager, 570-826-2511 or RA-EPWM-NERO@pa.gov, Northeast Region, 2 Public Square, Wilkes-Barre, PA 18701-1915, 570-826-2511.
Anyone aggrieved by this action can file an appeal with the Environmental Hearing Board within 30 days of this notice.
