DEP Invites Comments On Proposed Consent Decree Covering Wastewater Discharges To Continue Operation Of The Keystone And Conemaugh Coal-Fired Power Plants In Indiana And Armstrong Counties

The Department of Environmental Protection published notice in the January 10 PA Bulletin inviting comments on a proposed Consent Decree authorizing updated wastewater management requirements for the continued operation of the Conemaugh and Keystone coal-fired power plants in Indiana and Armstrong counties.  (

The 1,711 MW Conemaugh Generating Station is located in West Wheatfield Township, Indiana County and the 1,711 MW Keystone Generating Station is located in Plumcreek Township, Armstrong County and Armstrong Township, Indiana County.

The Keystone-Conemaugh Projects, LLC had previously notified DEP they would permanently cease coal combustion at the Conemaugh Station and the Keystone Station in 2028, however, KeyCon said PJM has expressed concerns regarding the facilities retiring due to an “unprecedented increase in electricity demand.”

KeyCon is now evaluating options to transition both facilities from a cessation pathway to a compliance pathway, according to EPA.

Recently, Keystone-Conemaugh Projects, LLC notified DEP it intended to convert to the voluntary incentives program for the flue gas desulfurization water and generally applicable bottom ash transport water limitations. 

The proposed Consent Decree provides a schedule for Keystone-Conemaugh Projects, LLC to install and begin operating bottom ash system upgrades at both Conemaugh Station and Keystone Station to meet Federal requirements for bottom ash transport water discharges.

No hearing has been scheduled on the proposed Consent Decree, but one may be requested.

Comments are due February 9-- 30 days after the notice.

After the close of the public comment period, the Department will evaluate and file responses to the comments received, and then ask the Indiana Court of Common Pleas to take appropriate action regarding the proposed Consent Decree.

Background

On December 1, 2025, representatives of the US Environmental Protection Agency met with representatives of Keystone-Conemaugh Projects, LLC to review the status of the facilities and waste and wastewater handling plans.
