PA Oil & Gas Industrial Facilities: Permit Notices, Opportunities To Comment - June 13

The following notices were published in the June 13 PA Bulletin related to oil and gas industry facilities.  Many of the notices offer the opportunity for public comments.

-- On May 12, 2026, DEP issued a new type of conventional oil and gas well permit for the purpose of allowing groundwater contaminated by oil and gas geologic formations to be dumped on roads and used in consumer products without restrictions, testing or treatment.  Read more here.

The new permit-- Conventional Oil & Gas Mineral Brine Well - Danylko 6-- was issued to BCD Properties and is now being drilled in McKean Township, Erie County.

Conventional oil and gas wells only produce a combination of three things-- oil, natural gas and contaminated groundwater-- “brine”-- that are locked in oil and gas geologic formations until released and discharged by conventional wells.

This new type of permit issued by DEP unilaterally and fundamentally changes the way these three things are regulated by creating an artificial distinction between “good” contaminated groundwater and “waste” contaminated groundwater that is exactly the same thing coming from the same geologic formations producing oil and gas.

This decision by DEP impacts the way an estimated 180 million gallons of contaminated groundwater produced by conventional wells every year will be managed from now on.   Read more here.

-- DEP published notice in the June 13 PA Bulletin announcing it has issued an Air Quality Plan Approval for the 1,034 MW Hickory Run Energy LLC natural gas power plant located in North Beaver Twp., Lawrence County.  (PA Bulletin, page 3570)

So far in 2026, DEP received or acted on 97 Act 2 Land Recycling notices related to oil and gas facility site cleanups.

-- National Fuel Gas Supply - Summit Compressor Station: DEP invites comments on an Air Quality Operating Permit for the facility located in Summit Twp., Erie County. (PA Bulletin, page 3543)

-- Expand Operating Co. - Shale Gas Well Pad: DEP renewed a GP-5A Air Quality General Permit for the facility located in Rush Twp., Susquehanna County. (PA Bulletin, page 3569)

-- Eastern Gas Transmission and Storage, Inc. - Tioga Compressor Station: DEP issued an amended Title V Air Quality Permit for the facility located in Farmington Twp., Tioga County. (PA Bulletin, page 3571)

Buckeye Terminal LLC - Pipeline Terminal: DEP invites comments on the renewal of an NPDES Wastewater Permit for the facility located in East Whiteland Twp., Chester County. (PA Bulletin, page 3530)
