DEP also fined the company $6,100 for not complying with a January 29 Consent Order and Agreement covering the same facility. The company paid $6,000 of the penalty as of September 2, according to DEP.
The January 29 Consent Order and Agreement outlined 21 pages of violations at the facility related to handling and storing waste, storage tank violations and lack of tank integrity testing, fluid releases, failure to submit discharge reports related to on-site wastewater treatment and many more. The Order listed 6 pages of actions Eureka was required to clean up all the waste remaining in the tanks and the facility and bring the facility into compliance, including payment of $375 in overdue storage tank registration fees. Read more here.
The Order required Eureka to pay $100/day in stipulated penalties for failing to comply with the Order, which means Eureka failed to comply for 61 days since the January 29 Agreement was signed.
DEP’s Air Quality Program also assessed a $2,000 penalty for air pollution violations at the Standing Stone Facility on May 7, 2025 which has not been paid.

Second Street Facility - Williamsport
DEP spokesperson Megan Lehman said the agency is continuing its investigation into the August 17 incident at the Eureka Resources Second Street Facility in Williamsport that resulted in a spill of an estimated 16,000 gallons of oil and gas wastewater that found its way to the Susquehanna River. “DEP is working with the agencies and entities involved with this case to explore all options and resources for carrying out cleanup efforts, which will continue as long as necessary.
“For clean-up actions addressed by the City and county authorities, it is at their discretion whether to seek cost recovery from the responsible party [Eureka Resources].”
DEP’s Air Quality Program also reported Eureka Resources failed to pay a civil penalty assessment of $2,000 for violations at the Second Street Facility.

DEP also reported Eureka Resources failed to pay a penalty assessment of $5.500 that was due from the company on August 31.
The Civil Penalty Assessment was issued on July 9 and listed four pages of violations at the facility.
