Protect PT: Commonwealth Court Vacates Penneco Oil & Gas Wastewater Injection Well Permit, Remanding It To Plum Boro For Additional Fact Finding In Allegheny County

On January 29,
Protect PT announced Commonwealth Court issued an opinion vacating the Court of Common Pleas of Allegheny County’s order affirming the decision of the Plum Zoning Hearing Board [Allegheny County] and remanding the Penneco Environmental Solutions, LLC Sadat 4a oil and gas wastewater injection well approval back to the Plum Borough Zoning Hearing Board. 

The order requires the Zoning Hearing Board to make additional findings of fact or to conduct further hearings to establish such facts prior to granting Penneco’s request to expand its injection well operations in Plum Borough.

The Commonwealth Court held that, while Penneco has a constitutional right to the natural expansion of its non-conforming injection well, that right is not without limitations. 

It stated that first, Penneco must present evidence that the expansion is a matter of “necessity… as the dictates of business and modernization require” (emphasis in the original). 

“‘[T]he expansion or modernization [must be] a matter of necessity for the business rather than merely to take advantage of an increase in business’ for the doctrine to be triggered.”

Second, “the right to natural expansion is not unlimited, the contemplated expansion must not be detrimental to the public health, welfare, and safety” (emphasis in the original). “[A] municipality certainly can condition such expansion on certain prerequisites and standards necessary for the preservation of the health, safety, and welfare of the community” (emphasis in the original).

Third, the court observed that the General Standards for all Conditional Uses or Special Exceptions require that the applicant, Penneco, comply with all requirements of “this” (the complete Plum Borough) Ordinance.

It requires the applicant to show “that the traffic from the proposed use will be accommodated in a safe and efficient manner… and that the proposed use shall not create a significant hazard to the public health, safety, and welfare.” 

The court noted that the Zoning Hearing Board made “no findings with respect to traffic, and no specific finding with respect to health, safety, and general welfare” (emphasis in the original).

Early in the opinion, the Commonwealth Court noted that the members of the Zoning Hearing Board stated, on the record, that they believed that they were powerless to stop Penneco from expanding their injection well, and would be required by the courts to grant Penneco their permit. 

The Court stated: “Despite its perception to the contrary, the Zoning Hearing Board was not powerless-consistent with Silver [decision] and the Ordinance-- to apply the requirements of the natural expansion doctrine and the plain terms of the Ordinance to regulate the location of the proposed expansion of the nonconforming use at issue here. It erred in believing otherwise.”

The matter is now back before the Zoning Hearing Board to determine whether Penneco is entitled to expand its injection well in Plum Borough.

DEP Assesses $73,153 Penalty On 2 Contractors Building A Rutter's Store In Blair County For Water Quality Violations; Exactly The Kind Of Violations A Citizen Group Was Afraid Of

On November 27, 2023, the Department of Environmental Protection
signed a consent assessment with M&G Realty, Inc. and Curry Excavating, Inc. that included a $73,153 penalty for water quality violations and failure to implement erosion and sedimentation controls at the 20-acre construction site for a Rutter's Store in Antis Township, Blair County.

The illegal activities impacted a segment of Sandy Run, a High Quality stream, and Exceptional Value wetlands.

The Blair County Conservation District did multiple inspections of the site in May, June, July and August of 2023 and found the companies failed to implement and/or maintain effective Best Management Places to prevent erosion and sedimentation from the site.

The companies failed to comply with the terms and conditions of the NPDES permit they were issued for the earth disturbance activities.

Blair County will receive $2,883 of the penalty and DEP will deposit $70,270 in the state Clean Water Fund.

In August 2022, members of the Little Juniata River Association raised concerns about the potential for construction and operation of the Rutter’s Store negatively impacting Sandy Run, a High Quality trout stream, and adjacent Exceptional Value wetlands.  Read more here.

Construction at the site began after DEP issued its permit in May 2023. Construction did not stop on the site.  The majority of the exterior construction appears complete.

Another Permit

On January 31, 2024, the Department of Environmental Protection issued an individual NPDES Stormwater Permit to M&G Realty, Inc. for the construction of Rutter’s Store #93 in Smithfield Township, Huntingdon County.  Read more here.

PA Solar Center: 2 Get Solar Projects Move Forward In Lawrence, Centre Counties; Get Solar Webinar Feb. 29; FirstEnergy Companies Double Solar Rebates

On January 30, the
PA Solar Center announced that two projects supported by its Get Solar Initiative recently moved forward in Centre and Lawrence Counties.

Lawrence County

Berner International, also known as Berner Air Curtains, has officially gone solar after going through the PA Solar Center's GET Solar program. 

The Shenango Township company’s “Solar Switch On” January 18th event at its Progress Avenue campus celebrated the launch of its solar array.

The array, five years in the making, began generating power in November and became fully operational in January, according to Berner CFO Denise Grady.

“It is not the end. It is a step towards sustainability,” Grady said. “It is an energy savings product. We always knew it was the right thing to do.”

Grady said Berner’s solar journey began with a conversation with Sharon Pillar, the executive director, and Leo Kowalski, the program director, of the nonprofit Pennsylvania Solar Center.

“Through their organization, we were able to get information on the current state of solar technology and funding options available,” Grady said. “We did the evaluation. It made financial sense, but more importantly, it was an outward sign of our mission of sustainability.”  Read more here.

Centre County

The Centre County Recycling and Refuse Authority is moving forward with a solar array project to provide 100% of the power at its facilities on Transfer Road in College Township. 

The authority’s board on January 8 awarded the bid for the $1.2 million project to State College-based solar energy company Envinity. 

Through our GET Solar program, the  Pennsylvania Solar Center facilitated the request for proposal process at no cost.

Solar panels will be installed on the roofs of the authority’s buildings and the array will be owned by CCRRA, so it will no longer need to pay a utility company for electricity. 

The array will have a lifespan of 25 to 30 years, and the initial investment is expected to be recovered in 7.2 years.  Read more here.

First Energy Solar Rebates

First Energy companies-- Met-Ed, Penelec, Penn Power, West Penn Power-- have doubled their ACT 129 rebate from $0.05/kWh to $0.10/kWh for solar projects that apply by 3/29/24. 

This is a one-time rebate that is calculated using the first year’s annual solar generation in kWh, capped at 50% of project costs, up to $500,000.
