Dooling enters this COA for the purpose of resolving its liability to the Commonwealth relating to existing contamination on the Site.
Under the COA, Dooling will remediate contamination at the Property in accordance with the Land Recycling and Environmental Remediation Standards Act and will receive a covenant not to sue and be eligible for contribution protection in connection with certain claims described in the COA.
The settlement agreement with 5627-41 Hegerman Street, LLC is to resolve certain enforcement claims regarding Hegerman’s failure to comply with a 2017 COA requiring the company to remediate the former Gryphin Coatings, Inc. Site.
In 2021, Hegerman sold the Site to Dooling, LLC which has agreed to complete the cleanup of the Site.
Pursuant to the Settlement, Hegerman has agreed to pay a stipulated civil penalty in the amount of $100,000 to resolve its liability for failure to comply with the 2017 COA.
DEP will accept comments on the proposed COA and settlement agreement for 60 days from this notice.
