PA Environment Digest Blog: DEP Designates Renewal Of Marcus Hook Terminal Air Quality Permit Subject To Environmental Justice Enhanced Public Participation; Stormwater Permit Also Pending

On July 31, 2024, the Department of Environmental Protection received an application from Energy Transfer Marketing & Terminals LP to renew the Title V Air Quality Operating Permit for the Marcus Hook Terminal facility located in Marcus Hook Borough, Delaware County. Publication of this notice opens a 30 day public comment period and an opportunity to request a public hearing during those 30 days. (PA Bulletin, page 5400)

In addition, the notice published in the August 24 PA Bulletin, said-- “Since the MHT [Marcus Hook Terminal] facility is a major facility located in an Environmental Justice (EJ) area, DEP will consider the TVOP [Title V Operating Permit] as an Opt-In permit subject to enhanced public participation.”

Air Quality Administrative Amendment

Another DEP notice in the August 24 PA Bulletin said DEP issued an administrative amendment to Air Quality approvals for the Energy Transfer Marketing & Terminals LP Marcus Hook Terminal incorporating the requirements of Plan Approval No. 23-0119E (revised) into the TVOP [Title V Air Quality Operating Permit]. (PA Bulletin, page 5432)

In addition, the amended TVOP incorporates the requirements of Plan Approval No. 23-0119K into the amended TVOP by reference for the facility located in Marcus Hook Borough, Delaware County. (PA Bulletin, page 5432)

Stormwater Permit

DEP also published a notice in the same August 24 PA Bulletin inviting comments on an Individual Stormwater Permit submitted by Energy Transfer Marketing & Terminals, LP for the Mariner East Ethane Expansion & Chilling Project covering a 28.5 acre site including a processing plant, 25 million gallons of storage and associated equipment impacting the Delaware River and located in Marcus Hook Borough, Delaware County. The notice did NOT include any reference to DEP’s Environmental Justice Policy.

Publication of this notice opens a 30 day public comment period on this application. This comment period may be extended an additional 15 days at the discretion of the Department.
